Been here for 20-something years and I've never heard this before. The license says non-free images of living people are allowed if no current photos are possible and there's no realistic way to obtain a free image. That's exactly what has happened. Two poorly composed copyrighted images were made available by the original writer, however it was shown that those images don't belong to them. When asked to clarify the license they didn't respond. The man is retired and out of the public eye for about a decade so the license requirements are met. The photo you uploaded doesn't really show him at all, just a blob of a man standing in a field for a corporate event. In other words, no reasonable person can identify Jerry Bird in the image you uploaded. And it's entirely possible that's not even him, we just don't know. Thanks for the photo + basic copyright question



Hey, nice photo of Jim Buck (dog walker) β†—! I'd like to upload more photos from old newspapers like this, but I'm still learning the copyright rules. I understand that in the United States, photos taken 1931–1977 are public domain if they were distributed without proper copyright notice, but in this case β†—, how would you check if the Times had attempted to assert copyright? :That's a very good question, actually. The best proof of this would be the original wirephoto lacking a copyright notice (see for example :File:Anthony K. Roberts 1974.jpg β†—). At this point, the only possible way that :File:Jim Buck walks six dogs in Central Park.jpg β†— would not be public domain would be that the AP inexplicably omitted notice in violation of a contractual obligation with the NYT and risked a lawsuit from the biggest newspaper in the United States. Needless to say, this was unlikely.
:Unfortunately, as far as I can tell, there is no copy of the original wirephoto online, so we have to settle for the next best thing: showing that every republication we have access to lacked an individual copyright notice for the photo. In general, when the wirephoto sent out by the AP had a copyright notice, newspapers dutifully reproduced it. For example, this photo of the Kent State massacre β†— had a copyright notice on the original wirephoto. If you look through your newspaper archive of choice, you'll very quickly find that republications included said copyright notice (with newspapers.com, the first two results for this photo https://www.newspapers.com/image/1109740372/?match=1&terms=%22kent%20state%22 β†—https://www.newspapers.com/image/561749964/?match=1&terms=%22kent%20state%22 β†— have the copyright notice, with only the third https://www.newspapers.com/image/342575354/?match=1&terms=%22kent%20state%22 β†— omitting it). In this case, we assume that the publications without a copyright notice were in violation of some contractual obligation. However, for the Jim Buck photo, literally every republication I found omitted a copyright notice for the photo. The chance of this happening if the original wirephoto had a copyright notice is basically zero. At this point, we essentially revert to the situation discussed in the previous paragraph and conclude that the photo is probably public domain to the extent that it passes c:COM:PCP β†— muster.
