The copyright issue for EBay slides

Alright, this is going to be difficult for me to deal with.

Here is my list of my last 100 uploads ↗, and you may notice a good chunk of them are photo slides which I state to have acquired from EBay sellers. I've started my own private collection of photo slides of trains and locomotives, and I only uploaded a portion of it on Commons Wikimedia, because multiple Wikipedia pages for steam locomotives (like Canadian Pacific 1278 ↗, which is remembered for its 1995 firebox failure) had been sorely lacking in proper images to represent them. I had also asked one seller if the copyrights to these slides would simply be carried over with the slides if they're each the sole individual copies of certain images, and they responded that it possibly would be the case.

So to answer your question on that Featured Picture nomination, no, none of the sellers or original owners (who have likely passed away years ago, anyway) personally assigned any copyright licenses on Commons. I simply '''assumed''' I'd gain the copyrights if I got the slides (as long as there are no other copies in existence) and thought it was alright to upload some of them myself. :I should say upfront that I am not a lawyer and this information is not legal advice, but based on what I know, I have bad news. I don't know where you're based, but in the US that is not how copyright works - nor anywhere else, as far as I know, though I'm less certain. The right to possess a work of art and the copyright for the intellectual property vested in that art are two different things. Unless you received an explicit grant of copyright from the prior legal holder, you don't have it and therefore can't give it away.
:There ''might'' be a loophole for images taken in or before 1987, if they were never copyrighted at publication, since you used to have to file copyright manually, but then you're getting into the weeds of having to prove when photographs were taken and also prove they were never published in a copyrighted form. Again, though, I'm not an expert, and you really want a lawyer for this. If I were you, I would find one of the Wikipedia portals and talk with people who know more than I do.
